Legal Question in Family Law in Pennsylvania

My ex and I have joint custody of our 9 yr son. My ex is now dating a girl that is horrible to my son and his father won't stick up for him. It was my ex's family that came to me about what had been going on. She is not physically abusive, but mentally. I want the joint custody to be the same, but do not want her to be around when he has our son. she and the ex just had a baby together and she looks to my son like he is a bother and in her way of her happiness. Also she has been violent in past relationships and I don't know what she could be capable of in a jealous rage. My ex is a good dad, but is so wrapped up in himself not thinking of my son. Is there any legal way I can allow my ex to see him but not have her around when that happens. I know she is very threatened by me and I don't know if she would take it out on my son. He is such a sweet little boy and doesn't say much. I was devorsed back in Dec of '06 I hope there is something legally I would be able to do because mental abuse is just as bad as physical.

First, what does your ex husband have to say about this. If his family is on your side it might help to have a family discussion to see if something could be worked out.

If that fails you could ask that the court change the custody order to limit you son's contact with step mom.

One way to accomplish this is to have a custody evaluator do an evaluation. The down side is such evaluations are expensive and take a fair amount of time.
