child custody

I am 6 months pregnant by an african man from sierra leone. I am not sure if he is legally in the U.S or not. I am fearful that he will try to take my child , my question is should I get custody of my child right after the birth?

You will have de facto custody at birth. It would be wise to file for custody after the child is born.

The short answer is yes. He would not be able to legally leave the country with your child since the baby would not have a passport, but it is a good idea to file for custody immediately if you beleive the father may take the child and not return it. Once the child is born you have de facto custody. That said you should file for court ordered custody once the child is born.
