child custody

I have primary physical custody of my 17 yo daughter - her father had visitation only as she and he had agreed to - meaning he had no rights except as she wanted to see him- now two years later she wants to live with him- I told her to go ahead and go if she was that miserible- but now almost a month later I have not been allowed to see her - should I just go pick her up since I have primary physical custody or because she wants to be with him - she I leave it alone until the hearing - I do not want to alienate her further- but this is just his way of getting at me' he tells her no when she asks him to come here for the afternoon- what can I do?

As she is 17 a custody contest at this point would be of limited value as once she turns 18 or graduates high school which ever happens LAST the courts lose jurisdiction.

In your county to file a custody action will cost you $110. Then it would go to a conciliation conference within a month or less. They seem to happen fairly quickly here. If an agreement is reached then a new order is put in place. If not then it goes to a hearing in front of a judge generally within a month of the conference.

The real question beyond time and costs is how your daughter will take this being an issue. She is of the age the court will probably listen to what she wants.

I need a lot more background to determine if it makes sense to take legal action.
