Thinking of seperating from my wife with the intention of divorcing her after a 90 day seperation. My wife has been the wage earner since we were married 15 yrs ago. I am diabled and am not able to work because of it. I collect nothing for my disability. I want to seek full custody of my child, she is 13, including alimony and chid support and a 50% division of all assits. She can have visitation rights but, I plan to move to North Carolina after this is settled. I have been the primary care giver since we were married. Is this possible according to Pennsylvannia law.

You asked about getting a divorce.

You really need to speak with an attorney. It would be extremely rare for a judge to approve full custody rights to a disabled non-wage earning father so that he could move. You may get alimony, you may get partial custody, but probably not so that you could move the child.

Speak with an attorney about your situation and either plan on outspending your wife to get a divorce or set your sights lower.
