Legal Question in Family Law in Pennsylvania

child custody vacation

I have a custody order saying I can take my oldest sun out of state for a week on vacation if i give my ex 2 weeks notice wich I did. She has known about it for the past six months and said that it was fine. Now she claims I didn't give her enough time in making our plans.

There is nothing of concent written because the court doc. and we agreed not to have to do this. I've taken him on vacation befor w/ no prob. Me ex is doing this because she is upset that I'm getting married. I did evrything in the court order right and I will have him on the weekend when we planed to leave. I'm afraid that she'll file a falls kidnapping charge or something. I don't know what to do because all of this on both side would end up being hearsay. I ahve wittnesses but w/ the types shy hangs out w/ I'm sure she could come up w/ the same.

What do I do? Please help.

Re: child custody vacation

It would be nice if there was some written proof of notice like an email or even a copy of a letter you sent notifying her of your plans.

Because the first thing the police will ask her is if there is a custody order. If there is the police will tell her its a civil matter and take you to court.

If you have any questions feel free to contact me. The initial consultation is free.
