Legal Question in Family Law in Pennsylvania

Child Custody - In violation or not?

We share custody and recently my daughters father has acquired a roomate. (He has not actually discussed this with me, I am assuming) This individual smokes - heavily. My daughter uses a nebulizer (lung apparatis for asthma patients) regulary. She (2years old) comes home smelling thickly of smoke. I believe he is putting her health at risk. Is this true?

Re: Child Custody - In violation or not?

I suggest you contact the pediatrician and ask him/her that question. If the Dr says it is not harmful, you can accept it or get another opinion. If the Dr says it is harmful, you should attempt an amicable resolution. In other words, get him to agree no exposure to smoking.

If no agreement can be reached, or he agrees but does not comply, you should go to court.

I trust this has been helpful, but feel free to call or e-mail for a free intial consult.
