My daugher was placed in foster care at birth by birth mom what are my rights as her birth father?

You have rights as the biological father. I would not hesitate to contact whatever agency your child is placed with and let them know you are around and interested in having custody of your child. At a certain point in time, the longer the child is in foster care, they will be looking at a permanency plan for your child-whether reunification with a parent, or termination of parental rights.
