Legal Question in Family Law in Pennsylvania

child' last name

I need help and i'm at a loss. I am enrolling my son in school on april 1st. Legally his last name is his fathers, who has not seen him since 6 months old and has made maybe 5 child support payments and is currently incarcerated yet again. We had left him due to his drug habits and all way back then. Anyways.... I want my son to have my last name and when he goes to school have it my last name. Even tho legally his last name is his fathers... can I enroll him in school with mine even tho while enrolling i have to have the birth certificate? Or is there something I can do to change it? His father has never agreed with changing it during the few random phone calls over the years, the last of which being just about a year ago. Any help is greatly appreciated.

Re: child' last name

You would have to file with the court for a name change. If the child's father opposes there will be a hearing and he'll have to state his reasons for opposing the change.

If you have any questions feel free to contact me. The initial consultation is free.
