Legal Question in Family Law in Pennsylvania

Child Relocation

I'm engaged to a woman living in Pennsylvania who has a child from a previous non-marriage relationship. She has not legally established custody or child support, but has her daughter 5 days a week. Is she allowed to move with her daughter down to Maryland?

Re: Child Relocation

You asked about custody of a child born out of wedlock.

The situation is the other way around. A father is non-custodial unless he has been granted legal custody. Unless the father has pursued the issue then generally there are no restrictions on the other parent's custody. Legally, a child born out of wedlock is under the sole custody of the mother, unless the court's decide otherwise (through a custody order or agreement).

Regards,

Roger
