child sleeping in room with father and girlfriend

is it legal for a 3 year old to be sleeping in the same room with his father and his fathers girlfriend

I'll assume you're the mother of the child.

There is no statute to say if it's legal or not.

The question becomes how does sleeping in the same room stack up to the best interests of the child.

That might depend on the judge or what is in the custody order. I could say it doesn't sound good but, I don't know who has primary custody, how often it happens or the gender of the child. All might effect the outcome of a hearing.
