Legal Question in Family Law in Pennsylvania

child support

How is child support calculated when the non-custodial parent is a full-time graduate student with 2 children from a subsequent marriage, and whose only income is child support for those 2 children (@$900/mo) and public assistance and when the custodial parent of the other 2 children has an earned income of approximately $75k/year.

Re: child support

Support is determined by the court imputing an income to the full time graduate student parent. Graduate school is a voluntary choice and the state believes that the children should not be deprived of parental support due to a voluntary choice of a parent reducing income.

Good luck to you.
