Child support

My fiance has two children from a previous relationship, they have joint custody with him having residential custody. We have the kids 10 months out of the year and she only sees them during summer break. She is trying to take us for child support but she has never paid us any support. Can she do this even though we have them for the majority of the time, and she has never paid us anything for their educational needs or well being needs?

Re: Child support

She can though at the end of it she will be ordered to pay child support. The non custodial parent can get a reduction in the amount of child support if the children spend at least 40% of the nights with the non custodial parent. That's 40% of the nights in a full year not any given month.

The only parent entitle to collect child support is the parent who has primary custody.
