Legal Question in Family Law in Pennsylvania
Child support when incarcerated.
I was incarcerated when the mother of my two children took me to child support court. I was released and now they say I have to make back payments from when I was incarcerated. How could I pay when I was not able to work I was in prison. The judge told me I could appeal but the law changed 5 years ago that it is legal for them to do a court order when the parent is incarcerated. My sister lives in the same state and she tried to take her son's father to child support court they told her she couldn't file because it was illegal to file for child support when the father is incarcerated. So what one person is different than the other she just filed in 2007 I've been incarcerated since 1999 and was released in 2005. What do I do. Can I appeal to the supreme court.
