Legal Question in Family Law in Pennsylvania

Child support

I pay child support for a child who lives in Washington State. She turns 18 on 12/13/05. She still is in school and graduates, 6/2006. According to my divorce decree, which was done in Florida, I pay support until child turns 18, marries or vol. is emancipated. I filed for emacipation and ex-wife is appealing and wants support until 6/2006. I now have to appear in a hearing to decide if I still have to pay. Can a special maater's overrule a divorce decree? Divorce decree does not state that I have to pay until child graduates from school, only when child turns 18. Will I lose this hearing and still have to pay until 6/2006, or legally can I have child emancipated this month?

Re: Child support

First, the jurisdiction for this matter is NOT Pennsylvania. Jurisdiction is where the child resides. In this case Washington state.

While I cannot say how a Washington judge might rule in Pennsylvania judges general extend support to graduation from high school. Its part of the equitable powers to do so. After all it is only six months.

I know that not what you want to hear but that is how it would come out in Pennsylvania. Would Washington be different? I cannot say you would have to ask an attorney from Washington,
