child support

I receive child support. My ex said he will move where he does not have to pay. Can he di this? Is there anywhere he can go that the order will not be enforced?

Not as long as he's a citizen of the United States or ever wishes to again step foot in this country. If a parent faces a support order and simply refuses to pay the recipient parent can seek an order to enforce and then has graduated recourse. This recourse includes a bench warrant for contempt in refusing to pay support.

Now, anywhere in the U.S. or U.S. territories a parent subject to such an order must pay and can through appropriate means be forced to pay. Sometimes it is easy sometimes it is extremely tough. When a parent gets too far behind an order can be made into a warrant. Now often it is difficult to get these warrants served. Except at airports, a person with such an outstanding warrant will often be arrested when trying to leave. Though this is not always the case.

But, when a person with an outstanding warrant for anything will be arrested on on arraival. Again, this is fairly certain on domestic flights, but is a guarantee on international flights.

Sure, your ex may be able to find a place where he won't have to pay child support. But the amount of support accrues, with compound statutory interest. The accrued amount doesn't expire until a time set by statute after the child is out of the statutory period (which not only differs from state to state but also may change based on situtaions or on future legislation).

There is nothing you can do about this and as there is obvious animosity you should leave the situation alone. Hire a lawyer or use the state resources to handle the matter. Do not allow even one payment to be missed without documenting it and reporting it to your agent (lawyer or caseworker).

Make certain that he is aware that his failure will be met with the most severe consequences. But don't deal with him directly.
