Legal Question in Family Law in Pennsylvania

Child Support & Social Security Disability

I am a Father of one son seeking child support for my son after 13 years of raising him on my own with very little help from his mother. I filed for support but have been put on hold, because his mother would not work and was waiting to be approved for disability. Finally after two years, she has been approved for SSD and will be getting her money. I now have a court date and will be deciding on child support, what I want to know is will my child support be retroactive since Social Security has told me that she will be receiving a lump sum of retroactive payments for her disability. In other words, will my first check be retroactive in payment? Also, do you advise with this situation, for me to hire a lawyer for this hearing? One other fact, the mother has been convicted of fraud in HUD and Food Stamps using my son as an asset, and would have no problem lying about anything on her forms for the support hearing.

Re: Child Support & Social Security Disability

Support is only retroactive from the date the complaint to establish it is filed. Having a lawyer at a support hearing can ensure you get the maxime amount of support allowable. I offer freee consultations.
