Legal Question in Family Law in Pennsylvania

Child sustody

My wife has primary physical custody and joint legal custody of her 5 yr old daughter. I am planning on reenlisting in the military which would mean we would have to move out of state (Pennsylvania.) Would I be able to reenlist without her losing physical custody?

if your wife intends to move out of state to reside with you, and she has primary physical custody, she can petition the court (at least in PA) for a "Plowman" petition, which is a request to the court that she wants to move out of state and wants the court to approve her request. Without the court's approval, your wife can be in "trouble" with the court. Call us for a free consultation.

Maybe. Depends on where you would be stationed, what would the opposing party agree to, as well as the standard in court of best interest of the child.
