Legal Question in Family Law in Pennsylvania

child visitation

my husband's ex-wife does not allow his 2 kids to see or speak to him. We live in Chicago and she lives in PA. The divorce papers mention nothing about the children. How can this be legal? She has changed her phone number and we cannot speak to the kids. This has been going on for 1 year. He does pay child support. What should he do in order to attempt to see his kids. The only paperwork for the divorce is one sheet of paper with a seal on it. Please advise.

Re: child visitation

From your description your husband never had the issue of custody addressed.

What he needs to do is get a custody order that spells out his rights to partial custody, not visitation. There's a big difference.

The exact procedure varies from county to county.

If you have any questions feel free to contact me. The initial consultation is free.

Re: child visitation

Depending on what the divorce judgment says, it may be possible to file a Petition for Rule to Show Cause or just a petition for visitation. One would need to review the divorce judgment and any joint parenting or marital settlement agreement to better advise on this. If you want to email me the documents, I would be interested in review them.

Good luck!
