Legal Question in Family Law in Pennsylvania

children declared to be legitimate

Hi,

I need the version of 5102 of the Pa Statutes which was valid in the year 1966 in order to find out, if a child that was born out of wedlock was legitimated through the subsequent wedding of his parents and which conditions had to be met (establishment of paternity ?).

Thank you.

Re: children declared to be legitimate

In most states a child is presumed a "legitmate" child of the marriage, if the parents marry within one year of the child's birth.

Further, if proof of the marriage (w/in the year) is shown, the birth certificate may be changed to show the (husband) father"s name and paternity, on the birth certificate; usually w/o court action or process.

Good luck,

Since 1966 the Supreme Court has issued a number of opinions which may have invalidated the statute in question. I would suggest contacting an attorney to discuss the underlying legal issue which gives rise to your question. I offer free consultations.
