The Children Left Behind

Recently my fiancee's ex wife took him back to court to have her support hired. Both my fiancee and his ex make less than 10 dollars an hour. His ex has enrolled the children in private school even though she knows they can no longer afford it. A judge who I thought would be intelligent enough to realize that they can not afford private school has ordered him to pay 62% of this tuition! We have a one year old daughter together but are not married. he is no longer contributing any money to the household because his entire paycheck goes into his gas tank. My question is this doesn't he have a responsibility to support my daughter as well and what can i do about making sure she is taken care of. As it stands right now we have no idea how we are going to provide for our daughter as his ex wife is getting pretty much all of his check.

Your fiancee has two issues.

The first is he should be calculated under multifamily guidelines. This should reduce the support paid to the ex. The second issue is the school tutition. Generally, he would be on the hook for it. However, if it consitutes such a large proportion of his income he could get relief with the right legal argument. I offer free consultations.
