Legal Question in Family Law in Pennsylvania

My children are in private school and I would like to keep my son in private school next year (his school ends at 8th grade). My ex wants him to go to the public school near him. My son is both gifted and has a Learning Disability and I want him to go to a school with a good track record in educating dual-exceptional kids. I've spent the last 6 months investigating schools, talking to teachers and parents. I've asked for his input all along the way. My ex has done nothing. He barely responds to my emails. The public school near my ex would be an incredible burden for me -- 40 minutes each way, morning and afternoon. For a total of 160 minutes in the car four days a week! How will I be able to work if I am forced to do this? Iam willing to negotiate and pay more than my ex- but he will not listen. I have had to pay 90% of remediation (about 30k) over the last year.

I have primary physical custody and my ex and I have joint legal custody.

If I take this to court what should I prepare for?

Without know what county this matter is in it is impossible to say what you need to prepare for. Some counties require a custody conciliation others don't. Even the manner in which custody conciliation is handle varies dramatically.

It would be my opinion that this is a matter that can and should be handled with a conciliation rather than going all the way to trial.

That said if the other side is going to be a jerk about it will go to trial. He is being a jerk. If he wants the child to be in public school why not the one near you?
