Legal Question in Family Law in Pennsylvania

New Citizenship after 5 years marriage, seeks divorce, any citizenship issues

A Romanian friend has just received her US citizenship on September 19th 2007. She has been married to a US citizen for the last 5 years living in this country. She wants to start a divorce process, but is afraid it may jeopardize her new citizenship status, and may also prevent her from getting the necessary paperwork through so that her mother can come and visit her from Romania.

You asked about citizenship status.

When a person takes the United States oath of citizenship there is almost no chance of having that status revoked. It would take an intentional unAmerican action (such as treason or terrorism) for revocation to even be considered.

In fact, generally a foreign citizen can divorce a U.S. citizen after a two year marriage without jeopardizing residency or potential citizenship.

Finally, as a citizen, a divorce will have little effect on a citizens ability to help another individual emmigrate to the U.S. That is not to say that bringing her mother will be easy, but as long as she can satisfy the support requirements and the mother can satisfy the immigration requirements then the person's emigration should just be a matter of proceeding through the system.

You will need the assistance of an attorney to help you complete the process effectively.

Good luck and regards,

Roger
