Legal Question in Family Law in Pennsylvania

contempt of court order

My exhusband is under a court order for his visitation of my minor children. He was to take anger management(court ordered) classes and have supervised visitations. He is restricted to 3 hours twice a week visitation. I have a PFA on him for myself for the physical and emotional abuse. This weekend he refused to take the supervisor with him and had my children unsupervised. I went to the court house and filed a contempt petition, but they won't give me legal advice. Do I have to let my children go with him now or can I cease visitation until the court hearing? I am still afraid of him and so are my children. Thank you [email protected] I anxiously await an answer

Re: contempt of court order

You need to file an emergency petition for contempt. If you are certain that the order states supervised visits and he refused the supervision then it is not violating the court order to not send your children. The order is key here and you must be certain of the terms. If there's any doubt as to whether or not he is to be in the company of the children unsupervised, do not deny visitation. If you know who the supervisor was, contact that person and get a statement. My best advise, as an attorney and as a mom is get counsel immediatly. Please understand that this is cursory advise based on the limited information supplied. You need to consult with an attorney.
