if there is no custody agreement in court and the mother has physical custody would she be considered full custody and if the father has visitation and is told not to leave the state during visitation can he be arrest for taking baby out of state

It's considered nothing there's no custody order. If Father is only getting visitation why is he taking the child anywhere? Visitation is when the non custodial parent comes to visit the child. Its partial custody when the non-custodial parent comes and takes the child to another place for a specified period of time.

In any case get a custody order.
