Legal Question in Family Law in Pennsylvania

There is no custody agreement between my ex-wife and myself. Can she leave the state with my children with-out my consent?

Yes, she can. Without a court order, each of you have equal and undivided rights to the child, meaning you can each move about with the child as you please and each of you has the right to stop visits with the other parents, if you wish to do so.

However, she can be stopped (at least temporarily) from moving to another state by filing a custody complaint. I would reccomend filing a custody complaint regardless, as this is the best way to protect your rights.
