Legal Question in Family Law in Pennsylvania

custody arrangements

my x husband signed off his rights to any sort of custody, I legally obtained sole legal and sole physical custody of our now 8yr old son. this was done 3 yrs ago, and he's made only 2 attempts to see him since. now he's threatening to sue for visitation rights. what are the chances he will get any as he hasn't seen the child in over 3yrs?

Re: custody arrangements

The standard in custody matters is best interest of the child.

The question is why in 3 years he has made so little attempt to see the child. Further why all of a sudden he wants visitation.

For dad to prevail he will have to prove that it is in the best interest of the child he should be allowed partial custody. Absent some good reason dad is likely to get to have some contact with the child. How much is hard to say. Also even though dad may win the right to custody it a right not a duty.

If you have any questions feel free to contact me. The initial consultation is free.
