Legal Question in Family Law in Pennsylvania

Custody / Child Support

My ex asked me to leave a few wks ago when i was 34 wks pregnant, said he needed to be alone, and then we could work on us. He then changed the locks on my to our jointy leased apt. and refused to let me in till i got cops involved. He says that he still wants to work on it. I am 4 weeks away from delivery of our son now. I was wondering can i sue him for the apt since the landlord doesn't want involved? When can i file for custody and support, does our son have to be born to do this? He kicked me out with $200 and no place to go except my parents couch. What can i do? I am currently gettin Wic, food stamps, and medical from welfare. Is there anything they can do?

Re: Custody / Child Support

If you are married, then you can file for spousal support. You cannot file for support or custody of a child that has not been born yet.
