Custody of my daughter

Through a mutal agreement that was notorized I have my daughter and dad can have visiting time when ever he wants to see her. He now doesn't seem to have anytime for her now. In the beginning he made some time for her but now he goes weeks at a time without contact. He only lives 1 town away. He sees his out of state girlfriend more than his own child. There is an agreement on child support and he never has the funds to get her meds as he's required to, the child support says the meds are on him after I reach my payment part. Can I take him to court for full custody? My daughters step dad to be spends more quality time with my daughter and she loves it. But when you mention dad she shrugs it off as if to say no great lose. Anyone have any suggestions. When I talk to dad he shrugs his shoulders as if to say so what do you want me to do. Partial custody or visitation is a right not an obligation. That is it is something one party may do or not do. Like the right to bar arms allows you the right to have a gun but doesn't require you to go out and get one.

The fact you reached a mutual agreement is a good thing unfortunately because he has no intention to exercise his rights under it it not worth much.

The fact its notarized means yes its has signature on the paper that's all.

You can NOT her biological father act like a dad. Even your child recognizes this.

Because there is no custody order by all means take him to court and get a custody order. Just to cover yourself.

As for the support agreement for your child's sake it should be a court order enforce through the domestic relations office of your county.

Yes you have multiple options, however the court is not going to be able to make her dad participate in her life.
