custody

i want to take my daughter out of state and i'm afraid that my husband will say that i'm kidknapping. What can I do?

Assuming you and your ex-husband cannot agree, then you will have to seek leave of court before you can take her out of state for an extended period. Is there a custody order in place? If so, does it cover this situation?

Question one: How long are you taking her out of state? A couple of hours, a weekend, indefinitely?

Question Two: Is there custody order? Generally custody orders spell out what you can and can't do. Generally, if you moving out of state he could take you to court and not let you take your daughter with you. That could happen whether there is a current order in place or not.

Question Three: Have you asked your husband what he thinks about your plans? There's an outside chance he might go along with it. You never know unless you ask.
