Custody for father

do I have any rights as a father to get custody of my 2 month old?

Yes you have standing to petition the court for custody. That said you will have to show the court why it is in the best interests of the child for you to have custody.

Assuming you do not have custody at this time the burden of persuasion you have is higher than if you were asking the court to change the status quo.

You definitely have rights. You certainly have as much of a right to custody as your child's mother. Although a number of factors weigh in on whether you receive custody or visitation, the legal test that courts use to determine custody issues is "what is in the best interests of the child." If you can establish in court that it is in the best interests of the child that you are awarded custody, then the court will rule in your favor.
