Custody Issue - Unfit enviroment

My children's father and I split up one and a half years ago. We have 2 children, ages 9 & 4. In that period of time, at times I have had to somewhat force him to see and take responsiblity for his kids. Three months ago, he had a 23 year old girl (he's 44) move in with him that he only knew for a little over a month. I was later told by my children about a certain incident where she was saying obsentities, racial slurs, and very inappropriate subject matter in front of my children. My 9 year old then says, '' The only reason that she did that was because these people were going to come shoot her.'' I have also found out that she has 2 daughters that she isn't raising. The oldest child she isn't allowed to see and I quote from my children, ''because she did something really, really bad when she was younger.'' The youngest child is living with her parent(s) and they don't bring the child to see her either. Can I prove that this is an unfit and inappropriate environment for my children to be in? Currently, we have no custody agreement through the court and due to what occurred, I am not allowing my children go to their father's house.

Step 1 file for custody! Without a custody order Dad could file for one and that could put you at disadvantage.

Proving that the environment is unfit on the testimony of children is difficult at best. It would be better to have adults testify to the girlfriends behavior. Besides children should not be brought into custody disputes.
