Custody issues

I have two children and neither I nor the father have legal custody through the courts. I have heard that because the father and I were never married and because the children have lived with me since the father and I split up, that I automatically have custody of the kids and could call the cops to get them back if he were to try to take them. I was hoping you could validate this for my state.

You are incorrect. The police treat custody issues as civil matters and try not to get involved.

You should file for a custody order.

Once you file there maybe a custody conference to see if you can agree to a custody arrangement. if you can its drafted into an order and signed by a judge. If there is no agreement it goes in front of a judge.
