Legal Question in Family Law in Pennsylvania

custody between New Jersey and Pennsylvania

I am a resident of New Jersey and I was given primary custody of my son's who lived in PA because their mother failed a court ordered alchol test. Now would I have any problem now that I've taken my boys back to live in NJ with me? Legally speaking?

Re: custody between New Jersey and Pennsylvania

I am unable to tell from your query whether your were granted custody in a custody proceeding or through a state initiated proceeding. If you were a declared resident of New Jersey at the time custody was awarded to you, there is no issue raised by your living in New Jersey. If you were a PA resident and are moving to NJ, there is a relocation issue which could be challenged by the children's mother. You would be reqired to prove to the court that the move was in the children's best interests. There are particular considerations that the court addresses in relocation cases which can be discussed with you by your attorney should the need arise.
