Legal Question in Family Law in Pennsylvania

Custody of a Minor

If a parent who has sole custody of a child wants to give custody/guardianship of the child to an of age sibling, what steps need to be taken? Is this something that must be handled by the courts in front of a judge?

Re: Custody of a Minor

Generally the part who wants to give custody to another person should have the proper paperwork filed with the court. You did say parent give custody to an older sibling. What does the other parent have to say? They should have notice of any such change. A guaridanship is a different proceeding requiring a court proceeding and notice to all interested parties as well. Guardianship usually involves control of finances of a minor or incapacitated party, though there can also be guardianship over the party which would grant legal control over the minor or incompetant. I suggest you speak further with an attorney to determine what is appropriate and involved in your situation. I f you would like to schedul an appointment at my office you can contact me.

I would initially say that whatever was to be done, it has to be approved by the Court. If it is done by agreement, meaning both parents want it to happen, a Judge will not stand in the way....

I can help you with the paperwork if you want. Please write back direct to [email protected].
