Custody and Moving

I am recently divorced and we have no custody agreement. My ex is mentally unstable and hes been suicidal lately. He refuses to get help. He also has a history of domestic violence and was charged with it about 3 years ago. I am fromGA living in PA and I would like to move home to get my son away from here. Since there is no legal custody agreement, can I move and what would happen if I did? Thank you, Stephanie

Stephanie-If you have lived in PA in excess of 6 mos., it has jurisdiction over your child. Even without a court order of custody, you should file to confirm custody and would also need to file for court permission to relocate to another state with your child. If you do not, the father could file an emergency petition and request an order that the child be brought back to PA and the GA authorities would ahve to cooperate.
