Custody papers

If two parents are not married and want to complete custody papers describing each parent gets 50% custody and neither parent can not move the child out of the state will a notarized statment signed by the parents, witnesses and notary hold up in court if one of the parents try to break what is written in the statement.

Usualy not. the advice to file a custody petition is advisable. There is a process in most counties for an agreed upon order.

The notarized statement would be enforceable as a contract, but not as a court order. The better option is for one party to file a custody complaint with the court and once they receive the court papers back, with the court case numbers, prepare, sign and file a custody agreement. That would provide both parties with stronger protection as they would have a court order to enforce.
