Legal Question in Family Law in Pennsylvania

Custody

My sister is a drug addict and alcoholic that is involved with man who is a convicted sex offender. She is separated from her husband who is also addicted to drugs and alcohol. They have a child that I feel would be better suited living with me. What are the chances that I could sue for custody?

Re: Custody

Your problem is one of standing. Even if all your allegations are true, where is your injury. Unless you have been acting as the custodians of the children for any length of time you can not take action in court.

That said if you feel that the living conditions of the children are such that mom and or dad shouldn't have custody then you should contact the Children and Youth Service in the county where the children live.

If you have any questions feel free to contact me. the initial consultation is free.
