My son's ( 8) birth father has not had contact at all with my son in 3 years. We have been to court 3 times to make him be a dad . That did not work . Now after him not calling or coming around in 3 years he wrote my son a letter from jail . He has no done anything on our court order besides not just showing up or calling he never did the homestudy or parenting class . Has not paid child support .Like he said he would .My husband and i are looking to move to Alabama . I am guess he has heard this . My guess this is why he wrote after all this time . He is playing games . I am sick of playing this game with him . Can I terminate his parental rights for this ?

No, you can't terminate his parental rights for that but you can terminate them.

To terminate his parental rights your child needs to be adopted. If your current husband is willing to adopt I would go that route. It should be pretty clear that the child father doesn't want to be a dad. If your husband is willing to adopt than you can have the dad terminate his parental rights either voluntarily or involuntarily. However, without adoption you can not terminate his parental rights.
