Legal Question in Family Law in Pennsylvania

custody

My 15 year old daughter is currently living with her father in Pennsylvania since I had to move to Virginia employment reasons. She has been wanting to live with me for about two years now. I thought it was best she live there since she had a sister in the home, too. Now her sister is 17 and will be attending college, but commuting. My ex husband refuses to let her go. Is she old enough to make her own decision?

Unless this daughter is subject to a custody order

which requires her to live with her father in Pennsylvania, she can make her way to your household in Virginia any time she pleases.

If there is a custody order you will have to file Pennsylvania to change it. At your daughter's age the court will listen to her. They aren't bound to follow what she asks but depending on the county and judge you get they would give her testimony great weight.
