My 17 year old step son told us tonight that he wants to live with us full time. Currently his mother has custody and her husband told him that if he wanted to move in with us it would go to court, that legally he had to stay in there home. He is now here and we wanted to know at the age of 17 what can he do to live here without racking up costly bills?

At 17 the courts will listen to him in deciding where he is to live. As a practical matter when the child turns 18 or graduates high school which ever comes last is the date he is emancipated and the court ordered custody becomes void

A petition to modify needs to be filed ASAP. If the 17 year old tells the court he wants to move in with father and has valid reasons for the move, it should not be a problem. Please contact me for free consult.

You asked about choice of custodial parent for a 17 year old.
Generally a child's decision at that age will be given great weight. Though, it is still a matter that the court must undertake to decide in its discretion.
Assuming the potential caregivers are reasonably well prepared to provide for the child's needs then it will likely be the child's reasonable wishes.
The fight should not be an expensive proposition and either of the attorneys who responded above should be able to help you readily.
