For almost three years I have had guardianship over my daughter. During this time the mother has been paying me child support, however, there were no legal documents ever signed regarding custody. The mother now whats custody of the child, she lives in NY and will be filing for custody in NY, My daughter and I reside in Pa, I just wanted to know where the jurisdiction is, would it go through the courts in NY or Pa? Also my daughter is 15, does she have a say in this matter, if she choses to live with her mother will they just sign her over?

Jurisdiction is in Pennsylvania. Its based on where the child has lived for the 6 months prior to the filing of a custody petition.
So you may wish to file for custody in Pennsylvania before the child mother files in New York.

i recommend you file a petition for custody first before she does! that usually establishes jurisdiction if one parent resided their by the state requisite amount of time...usually 6 months. Please call or email for a free consultation.
