The denial of visitation is one of the factors considered in determining custody. You can apply for custody. Even if you are unsuccessful your application should put the fear of god in the mother.

You need to petition the court for visitation. You have the right to have access to your daughter. Whether you can get custody will be determined by several factors. YOu need to consult with an attorney.
