Legal Question in Family Law in Pennsylvania
Defamation and Protective Orders
In a situation where one parent lies about another parent in order to get a protective order against him so that she can have ''custody'' over the child, can that protective order be thrown out? Also, can the parent who was lied about go after the other parent in court? In this situation, no custody agreement or order has been issued.

Re: Defamation and Protective Orders
A final Order can be appealed, a temporary Order will have a hearing prior to a final Order being issued.
It may be a good idea to have an attorney at your side if the other party is lying.
Good luck to you.
