Legal Question in Family Law in Pennsylvania

Discovery and/or subpoena

Filed Pro Se for custody modification. Currently have 50/50 on all. Requesting modification due to exs mental and drug issues.

Can I, without an attorney, file either for discovery or subpoena of recent medical records listing drug and bi-polar/manic dep. problems?

Which one do I file, do you know a link for Allegheny County to print out the proper forms?

Thank You.

Re: Discovery and/or subpoena

Discovery in family court can only be conducted upon leave of court. You must petition court to get authority to do it. As to subpeonas most medical providers will not respond solely to a subpeona and therefore you may need to petition the court to force the opposing party to authorize the release.
