Divorce and Business Ownership

My husband and I are getting a divorce and we own a business together. We are both fighting over who gets the business. I built this business to where it is and--name removed--hasn't worked at all. Rather then fighting over it, I would like to start the same company (Home Care for Seniors) in a different name and take my clients and caregivers with me and leave him our current business. Is this illegal? If so, what can--name removed--do to me?

If you have not already done so you should immediately consult with an attorney familiar with family law and distribution of family owned businesses.
