Legal Question in Family Law in Pennsylvania

Divorce & buying a house

My husband is in the process of buying a house. I am finding myself in a place where I need to leave the marriage. If I file for divorce now, will that hurt his ability to get a mortgage? He is already approved for one. I don't want to hurt him unnecessarily. On the other hand, if I wait until after the house is bought, will I then share that debt and dig my own hole, because I am not planning on living in that house after the divorce is final. What is the best time to file? What should I do?

Re: Divorce & buying a house

I have no idea if a divorce will hurt his chances to get a mortgage. However, assuming he's the only name on the mortgage and promissory note then its not your debt. The house however would be a martial asset.

Assuming you are going ahead with a divorce you and your husband should negotiate a martial property agreement.
