Legal Question in Family Law in Pennsylvania

Divorce decree without any f inancial settlement

I was divorced in 1992 after automatic divorce because my husband contested it. There was never any financial settlement. My mother established a Trust in 1996. She died in Dec. 2007.

Does my ex-husband have any claim on my inheritance? He inherited money after our divorce.also.

Re: Divorce decree without any f inancial settlement

You asked about inheritance and divorce.

Inheritance is a special animal. Often, an inheritance received during a marriage can even be safe from claim in a divorce so long as the funds are segregated (not intermingled with marital assets).

In your case, the divorce was final and even though there was no financial settlement the inherited money is probably still safe from consideration. Often, a financial settlement does not need to be part of a divorce proceeding. The fact that there was no settlement does not change the fact that the divorce was final, in the worst case a person could go back and seek a settlement based on the assets as they stood at the date of the divorce.

Regards,

Roger

I agree with the response of the attorney. Once you were divorced that should have extinquished any claim of your ex husband in any inheritance.
