I am asking in the event of a divore would I have to split my house with my husband, we both live there now with 2 children. The house was given to me the wife as an inheritance from my uncle about 6 years ago before that we lived in an apartment. so we moved in the house. The deed is in my name only and we took a home equity or mortage loan
for 25,000.00 I am primary on this loan my husband is second
payer. I want to remain in the house after a divorce with my children and want him to leave. But down the line if I should sell the property do I have to give any of the profit? Also will he be reposible for half of the mortgage
and how does that work do they split it and I pay my own half? thank you for your help joan

The payments made on the mortgage are presumably from your incomes. Incomes are considered marital property and therefore he would have some claim to that. Also, the increase in the property value is also a marital asset. I offer free consultations.
