Divorce

Married 27 yrs. I make more money than my husband, does that mean I have to pay support? I make $70000 he makes $40000. I have the 401 K, health insurance. we have 2 kids, 16 and 20 both in school. how will this effect me financially?

On the support question, it is going to depend on some facts that you haven't stated. The first is who will have primary custody of the 16 year. The 20 year is not entitled to court ordered support. If you have custody dad would be pay child support to you until the child turns 18 or finishes high school which ever occurs last.

Your husband might get spousal support until the divorce is final but that's not a given.

After the divorce he would only get alimony if the results of equitable distribution are inadequate for him to get on with his life post divorce.

The portion of the 401(k) is subject to equitable distribution, however, without knowing what other marital assets there are it would be impossible to say how that might be divided up.

Until your divorced you will have to cover dad and the kids. More than likely you will have to keep insuring the kids post divorce.
