Divorce

If I move out of my house before applying for a divorce what are the circumstances involved. My friends say this is disertion. We live in the same house but separate bedrooms, we do not have anything to do with each other, just exist.

Hopefully none of your friends are lawyers.

Because you are in separate bedrooms you are no longer cohabitating. So for purposes of determining when you separated it started when you started living in the other bedroom.

Now whether its a good idea to move out prior to filing for divorce depends on facts you have not included. Such as are there children of the marriage.
